1. Acceptance of Terms

Welcome to ExamWise. By accessing or using our platform, services, and features, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and ExamWise. We reserve the right to modify these Terms at any time, and we will notify you of material changes by posting an updated version on our platform.

2. Description of Services

ExamWise provides an online exam preparation platform for A-Level students, offering:

  • Vision Search: Upload question images to find similar exam questions
  • Exam Builder: Generate custom practice worksheets based on your preferences
  • Wizard: AI-powered trend analysis for subjects and topics
  • Community Solutions: Submit, view, and discuss solution approaches with peers
  • StudyHub: Track your practice progress, mastery levels, and performance analytics
  • Premium Subscriptions: Access to enhanced features and increased usage limits

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account. You can register using:

  • Email and password (local authentication)
  • Google OAuth (third-party authentication)

3.2 Account Responsibilities

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account
  • Not share your account with others or create multiple accounts

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm our platform or other users.

4. Subscription and Payments

4.1 Subscription Tiers

ExamWise offers different subscription tiers with varying features and usage limits:

  • Free Tier: Limited access to basic features
  • Premium Tiers: Enhanced features, increased usage limits, and priority support

4.2 Payment Processing

Payments are processed securely through Stripe. By subscribing to a premium tier, you authorize us to charge your payment method for a one type payment based on your subscription

4.3 Billing and Renewal

  • Payments are ONE TIME only
  • You will be charged the cost of the monthly tier cost * numbe of months
  • You have a 14 day period to request a refund

14 day window to refund after you purchased a tier

5. User Content and Community Guidelines

5.1 User-Generated Content

When you submit content to Community Solutions (solutions, comments, images), you:

  • Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content
  • Represent that you have the right to share the content
  • Retain ownership of your intellectual property rights
  • Acknowledge that your content will be publicly visible to other users

5.2 Prohibited Content

You may not submit content that:

  • Contains profanity, hate speech, or offensive material
  • Violates intellectual property rights of others
  • Contains personal information of others without consent
  • Is spam, advertising, or promotional material
  • Contains malware, viruses, or malicious code
  • Violates any applicable laws or regulations

5.3 Content Moderation

We reserve the right to review, moderate, or remove any user-generated content that violates these Terms. We use automated profanity filtering and manual review to maintain a safe learning environment.

5.4 Content Deletion

You may delete your own solutions and comments at any time. If your account is deleted, your community contributions may be retained with an "Unknown User" attribution to preserve the integrity of discussions.

6. Acceptable Use Policy

You agree not to:

  • Use our services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the operation of our platform
  • Use automated scripts, bots, or crawlers without permission
  • Reverse engineer, decompile, or disassemble our software
  • Redistribute exam questions or copyrighted materials
  • Circumvent usage limits or access restrictions
  • Harass, threaten, or intimidate other users
  • Impersonate others or misrepresent your affiliation

7. Intellectual Property Rights

7.1 ExamWise Content

All content, features, and functionality on our platform (including text, graphics, logos, software) are owned by ExamWise or by an exam board such as Cambridge Interntional Examinations in the case of exam questions, we derive them from past papers which are open to the public. Examwise never uses non released past papers to source our database, as this is against the TOS of Cambridge

7.2 Exam Questions

Exam questions are sourced from publicly available past papers and are the property of their respective examination boards. We provide these questions for educational purposes only. Users should refer to the original examination boards for official materials.

7.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for your personal, non-commercial educational purposes. This license does not include the right to download, copy, modify, or redistribute our content except as expressly permitted.

8. Disclaimers and Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that our services will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or quality of content
  • Warranties regarding exam success or academic performance

ExamWise is a study aid and supplementary resource. We do not guarantee exam results or academic success. Your performance depends on your own effort, preparation, and abilities.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXAMWISE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or other intangible losses
  • Damages resulting from your use or inability to use our services
  • Damages resulting from unauthorized access to your account or data
  • Damages resulting from errors, omissions, or inaccuracies in content
  • Damages resulting from third-party content or actions

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR £100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless ExamWise and its affiliates, officers, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of our services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Content you submit to our platform

11. Third-Party Services and Links

Our platform may contain links to third-party websites or services (such as Google OAuth, Stripe) that are not owned or controlled by ExamWise. We have no control over and assume no responsibility for the content, privacy policies, or practices of third-party services.

You acknowledge and agree that ExamWise shall not be responsible or liable for any damage or loss caused by your use of third-party services.

12. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may delete your account at any time through your account settings. Upon account deletion, your personal data will be deleted or anonymized in accordance with our Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting an updated version on our platform
  • Updating the "Last Updated" date at the top of this page
  • Sending you an email notification (for significant changes)

Your continued use of our services after changes become effective constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ExamWise regarding your use of our services and supersede all prior agreements and understandings.
